Seth Rogen's new film Observe and Report is under fire over a "date rape" scene in which Rogen's character has sex with an unconscious female after heavy drug and alcohol use.

It's hard to discuss this without having seen the movie.
Were they about to do it anyway and she passed out? Was he as drunk as she was? I mean, I certainly wouldn't consider it date rape if two people about to fuck were extremely inebriated and one of them kept going after the other passed out.
If you just go fuck someone who's passed out then yeah, it's rape.
Still, if chicks can go get drunk and fuck someone then turn around and claim that they didn't know what they were doing and ruin some dude's life, then why can't guys also use the defense that they themselves were drunk and didn't know what they were doing?
Really, if that defense seems ridiculous (that I didn't rape someone because I was drunk and not fully aware of my actions) then how can a woman saying "yeah I got fucked, but I was too drunk to really know what I was doing and he shouldn't have gone along with it so that makes it rape" not seem equally as ridiculous?

from what I understand the two sides play it out like this
Yes! It's date rape
There is a scene where the woman continuously takes shots, SR's character does not. Therefore, he is 100% sober, and she is not. Other scenes show her completely inebriated, and he is still of sound mind. Therefore the sex scene is date rape, since the character is too drunk to be actually consenting. Therefore, SR is making light of sexual assault.
No! It's not date rape
There is dramatic tension when SR's character is clearly having sex with what seems like a passed out woman. SR's character asks the female character to acknowledge the act and she does not at first... SR's character immediately develops a worried look... but she responds with "Motherfucker, Don't stop!" (or whatever it was), thus acknowledging the act and thus giving her consent.
As a side note, i completely agree with you, Krsna, and I'm a proud feminist.
There's a difference between drunk girl at the bar looking for attention syndrome, and someone who has been drugged and taken advantage of. Rape is a serious charge, but I think it can (sometimes) be thrown around to destroy men, to make right on something that someone now regrets.
It's hard to say exactly what's happening in the scene. Did the character say "NO" at any point? No, when a person MEANS no, is rape. But that doesn't seem to be the case.
It just seems to be some pretty confusing writing that SR ought to put a clear statement out explaining his intentions to shut everyone up, on both sides.

I found the movie surprisingly entertaining.
And no that was not rape in my opinion. Although she was fucked up she obviously slammed that shit down just so she could go through with it. In my opinion.

I agree on the both being drunk point.
When my brother was working as a residential assistant at the university we both attended, he said the school's position was that if the girl had a single drink, it could be considered rape. I think that in particular is a load of bullshit. I could potentially not even know a girl had a drink and get charged with rape later. I don't know if the charges would actually stick, but it's pretty terrifying to think about.

The movie was supposed to be a black comedy, with a lot of scenes intended to be open to interpretation fantasy(the ending included), and the "sex scene" is included. He had become so immersed in the world outside of reality that he didn't really know what he was doing at all. You do know he's supposed to? be bipolar and off his medication, right?
Maybe it's also a backhanded comment that the character is a dead fuck?
